A drug testing protocol for both legal and illegal drugs was an unlawful medical examination, and the follow up questions about lawful drug use were unlawful disability-related inquiries, according to a federal district court in Tennessee. Bates v. Dura Automotive Systems, Inc., (Aug. 29, 2011). The court rejected the company’s motion to set aside a jury verdict for the plaintiffs. The jury had found that the examination and inquiries were not “job-related and consistent with business necessity,” as required by the ADA.

Employer Utilizing WorkSTEPS Program is Missouri's "Best in Safety" Recently Howell-Oregon Electric Cooperative (HOEC) employees crossed a milestone when they completed over 800,000 hours of safety. Dan Singletary, CEO/General Manager at HOEC, accepted a "no loss time" award on behalf of all HOEC employees. Ranked number one among 40 electric cooperatives in the state of Missouri, Howell-Oregon Electric Cooperative (HOEC) employees have crossed a milestone by completing over 800,000 hours with "no loss time". All HOEC employees have passed this mark without any individual missing time for injury caused during working hours. As a result of this accomplishment, HOEC recently received an award from the Association of Missouri Electric Cooperatives (AMEC) at the 2011 Annual Meeting of membership of the association held in October. AMEC coordinates efforts among the electric cooperatives in the state to train line employees to be safe, as well as coordinating efforts during storm restoration in Missouri. During the time period the "no loss time" hours were achieved, many HOEC employees worked in dangerous situations to restore power after major storms. The worst included winds of Hurricane Ike in 2008 as well as the most damaging ice storm in the history of the cooperative in 2009. Each of these devastating events created conditions which cooperative personnel worked through without harm to any individual. Safety training is an on-going process at HOEC. Each month, Jack Hawkins, Manager of Operations, conducts a meeting where issues are discussed and safety practices are put in place. Hawkins often has guest speakers from AMEC that specialize in safety training.
"Working safe is an on-going focus every day of all employees at the cooperative. Injury can happen at anytime in the workplace, regardless if an accident occurs working in the office, the warehouse or out in the field", said Dan Singletary, CEO/General Manager at HOEC. "I am proud of our employee team for receiving this prestigious award."
HOEC has been utilizing the WorkSTEPS Testing Program at Physical Therapy Specialists Clinic in West Plains, MO, for new hires and individuals returning to work. Dan Singletary wrote in a letter of recommendation "I feel the WorkSTEPS Program reassures our personnel that they are physically ready to return to work and it also assures any new employees that they are capable of performing the physical duties of the position that they are being hired for...I will continue to recommend this program to other cooperatives for I feel it has benefited Howell-Oregon Electric Cooperative in controlling our injury rate, which contributes to loss work days."

The distinction was published in 2007, although we wouldn't be surprised to hear the relentlessly candid and humble Canadian is working on a five-peat. But the competition for Most Amazing is fierce.
And it seems to be all around him.
MacDermott had checked in at the Rio Verde Country Club and was getting the lay of the land in preparation for a national tournament. As an at-least-once bestowed member of the WMAG club, MacDermott was more than happy to dispense a measure of related wisdom.
