EEOC RELEASES NEW ADA REGULATIONS, IMPLEMENTING 2008 ADA AMENDMENTS ACT By: Francis P. Alvarez Date: 03/25/2011 The Equal Employment Opportunity Commission has released long-awaited Final Regulations implementing the ADA Amendments Act (ADAAA). The ADAAA was signed into law on September 25, 2008, and became effective on January 1, 2009. The Final Regulations will become effective on May 24, 2011, 60 days from March 25, 2011, the date they were published in the Federal Register.
Rules of Construction The Final Regulations reaffirm the purpose of the ADAAA: to make it easier for individuals with disabilities to obtain the ADA’s protection. The ADAAA made clear that the primary focus in ADA cases should be on whether employers complied with their obligations under the statute and whether discrimination occurred, not whether individuals are disabled under the law... "Missing Link" Significantly Impacts Waste in Work Injury Management" Published in: Self Funding Magazine
Statistics prove that the best way to treat any injury or illness is to prevent it from ever occurring. Even so, there are many debates about what interventions are the most effective and which ones achieve the highest levels of success. In the last issue of Self Funding Magazine, there were valuable references to cost containment for medications and the significance of “doctor shopping” for successful work injury management. But one of the most important “missing links” employers are discovering nationwide is the use of virtual essential function testing that focuses on “measured” job matching at all stages of the employment process. Standardized medical and essential function assessments are a positive bio-ergonomic intervention that measure human strength and performance according to each jobs requirements (content validity), and then appropriately match the worker to the physical demands of their job no matter what the stage of employment. Such testing has shown to reduce injuries and costs per claim as much as 81% the first year in high volume employers (thousands of employees) and an average of 50% in all industries nationwide. The National Amputee Golf Association - First Swing Program
The National Amputee Golf Association (NAGA) conducts numerous nationwide "First Swing" seminars and "Learn to Golf" clinics annually. The one-or-two day clinics bring golf professionals, physical and recreational therapists, and the physically challenged together to teach, learn, and enjoy golf.
The First Swing began in 1988 and was developed and implemented by a double below knee amputee, Bob Wilson, National Amputee Golf Association Executive Director. The program was designed to instruct therapists to teach and encourage the disabled to learn, or re-learn, the game of golf. This is not only because virtually every physically challenged individual, regardless of age or type of disability, is able to play golf, but also because it contributes dramatically to the individual’s emotional and physical well-being, instilling self-confidence and pride in personal achievement.
