Worker Who Cannot Perform Essential Job Function Has No Disability Accommodation Claim, Federal Court Says

The duty to reasonably accommodate an employee with a disability does not include ignoring the essential functions of a job, a federal district court in Washington has ruled.  McEnroe v. Microsoft Corp., No. CV-09-5053-LRS (E.D. Wash. Nov. 18, 2010).  The court granted summary judgment to the employer on the plaintiff-employee’s failure-to-accommodate claims under the Americans with Disabilities Act and the Washington Law Against Discrimination.

Healing for Haiti
An Apple a Day Magazine

My experience with Haiti started in February when my daughter Rachel, a registered nurse, called me and said she would be spending her vacation working at the Mission of Hope hospital in Haiti for nine days. I was instantly touched and so proud of her, but also very afraid for her safety, as she would be going only five weeks after the earthquake. When she arrived, she discovered a nation rich in beauty, but desperate in daily life. She described the Mission compound where she was working as a hospital, medical clinic, and orphanage spanning over 100 acres in the foothills approximately 20 miles from Port Au Prince, Haiti. All the buildings on campus were destroyed except the housing for the children and the school. School was cancelled and the classrooms soon became the medical triage and the hospital. Mattresses were placed on the floor and were quickly filled with the injured and ill people, many of them who had not been treated at all since the quake.

  TECHNOLOGY CORNER 

Hello All!
The CFO has loosened the purse strings and software programming has begun. Over the next month or so, you’ll begin seeing subtle changes to the online testing software. Many of the changes are issues reported by providers, some are upgrades, and others are being made because our attorneys raised a ruckus. By March 14th, 2011, we should be completed, and at that time we’ll post the updated data entry forms on the server for download.
WorkSTEPS values your comments, suggestions, and notification of issues with the software; please keep them coming. We may not be able to implement them all, but we do keep them on file and review them regularly.
